CHARTER AMENDMENT NO. 14

LIQUOR COMMISSION MEMBERSHIP

 

BE IT ENACTED BY THE PEOPLE OF THE COUNTY OF HAWAII:

Section 1. Section 7-3.2 of the Hawaii County Charter is amended to read as follows:

"Section 7-3.2. Liquor Commission. There shall be a liquor commission consisting of [seven] nine members who shall be appointed by the mayor and confirmed by the council in the manner prescribed in Section 13-4. [Commission membership shall be representative of the community and of the county geographical areas of Puna, Ka`u, Kona, Kohala, Hamakua, and Hilo.] One member shall be a resident of each council district. The liquor commission shall:

(a) Adopt rules and regulations having the force and effect of law for the administration of liquor control in the county and to carry out provisions of the liquor control laws of the state.

(b) Grant, renew or refuse applications for licenses of the manufacture, importation and sale of liquor in the county under applicable laws and regulations.

(c) Have such other powers and duties as may be provided by law, not in conflict with the provisions of this section."

Section 2. Article 16 of the Hawaii County Charter is amended by adding a new section to be appropriately numbered and to read as follows:

"Section ___. Boards and Commissions with District Residency Requirements. Any commission member serving at the time of the adoption of a council district residency requirement in the year 2000 may serve the remainder of the term, regardless of residency. Any vacancy must be filled by a resident of a council district not represented on the commission."

 

Section 3. To allow for the staggering of terms, one of the two new commissioners shall be appointed to a five year term. The other shall be appointed to a one-year term, and shall be eligible for a second term under section 13-4(c).

Section 4. Charter material to be repealed is bracketed. New charter material is underscored.

Section 5. This amendment shall take effect at noon on the first Monday in December following its approval by the voters.
