Immigration Information on Child Citizenship Act Of 2000

Hawai`i County offers an immigration information service located at the County Building at 101 Pauahi Street. Suite 9, Hilo in an effort to help the many people who need advice about U.S. visa and other immigration matters.

This service provides information only, because U.S. visa issuance and other immigration matters are handled by the federal government’s U.S. Citizenship and Immigration Services, a bureau of the Department of Homeland Security.

Our Immigration Information Specialist is frequently asked about citizenship for children of U.S. citizens who are born abroad.

This brief article discusses the Child Citizenship Act of 2000, which became effective February 27, 2001.

The aim of this law is to facilitate the automatic acquisition of U.S. citizenship for both biological and adopted children of U.S. citizens who are born abroad and who do not acquire U.S. citizenship at birth.

Because of this law, U.S. citizenship is conferred automatically upon thousands of children in the United States.

Requirements

1. At least one parent of the child is a U.S. citizen, citizens by birth or naturalization.

2. The child is under the age of 18.

3. The child must be residing in the United States in the legal and physical custody of the U.S. citizen parent after having been lawfully admitted into this country as an immigrant for lawful permanent residence.

4. If the child has been adopted, the adoption must be final.

Frequently-Asked Questions about the Child Citizenship Act

Q: Does the Act apply to foreign-born children who have immigrated to the United States in order to be adopted as well as to those who have been adopted abroad?

A: Yes. Children who have immigrated to the United States in order to be adopted become citizens as soon as the adoption decree is final.

Q: Does it matter in which order the requirements are met?

A: No. The order does not matter. Citizenship is acquired automatically as soon as all of the requirements have been met.

Q: Will a child who has met the requirements of this new law need to apply for a passport from the State Department or a Certificate of Citizenship from the U.S. Citizenship and Immigration Services (USCIS) in order to become a citizen?

A: No. As soon as the law's requirements have been met, the child acquires U.S. citizenship automatically without the need to apply for either a passport or a Certificate of Citizenship.

Q: What documents are required to obtain a passport for a child who became a U.S. citizen under the Act?

A: The following documents are required:

  1. Evidence of the child's relationship to a U.S. citizen parent (a certified. copy of the foreign birth certificate for children born to an American or, if adopted, a certified copy of the final adoption decree)
  2. The child's foreign passport with USCIS’s 1-551 stamp or the child's resident alien card and;
  3. The parent's valid identification.

Q: How does someone prove admission into the United States as an immigrant for lawful permanent residence?

A: Either the child's permanent resident alien card, commonly known as a green card, or an I -551 stamp placed in the child's passport by USCIS.

Q: How does a child demonstrate adoption in order to obtain a passport and/or Certificate of Citizenship?

A: By presenting a certified copy of a final adoption decree.

Q: Are the Act's provisions retroactive in applicability?

A: No. Individuals who were 18 years of age or older on February 27. 2001 will not be able to take advantage of the Act.

Q: What is the effective date of U.S. citizenship for children who met all the requirements of the new law prior to February 27. 2001?

A: The effective date is February 27, 2001. Even though the requirements were met before the Act's effective date, citizenship is only acquired on that date.

Q: Will U.S. embassies and consulates issue reports of birth to children acquiring citizenship pursuant to this Act?

A: No. Reports of birth are issued only to children who acquire citizenship at birth.

The Act's Other Provisions:

Another section of this new law provides that children (biological and adopted) of U.S. citizens who are born and reside abroad (that is, they did not enter the U.S. as permanent residents) and who don't become U.S. citizens at birth can apply to USCIS for a certificate of citizenship if the following conditions are met:

  1. At least one parent of the child is a U.S. citizen. whether by birth or naturalization.
  2. The U.S. citizen parent has been physically present in the U.S. for a total of at least five years, at least two of which are were after the age of 14. If the child's U.S. citizen parent cannot meet this requirement, it is enough if one of the child's U.S. citizen grandparents can meet it.
  3. The child is under the age of eighteen.
  4. The child resides abroad in the legal and physical custody of the U.S. citizen parent and has been lawfully admitted into the United States as a non-immigrant.

Children who acquire citizenship under this new provision do not acquire citizenship automatically. Rather they must apply to USCIS for a certificate of citizenship and go through the naturalization process.

County Invites Public to Christmas Open House Dec 16

The County of Hawai`i’s Culture and Community Arts Section cordially invites the public to a Christmas Open House on Thursday, December 16 from 6 p.m. to 8 p.m.

The Christmas Open House will once again be held at the County Building at 25 Aupuni Street .

All of the County departments have collaborated and coordinated holiday decorations and creative exhibits to light up the season. Light refreshments will be provided.

Entertainment this year will showcase the talents of our Hawai`i Island youth. The Waiakea Ukelele Band will perform at 6 p.m., followed Pahoa High School’s Na Pua Mae’ole Program at 7 p.m.

The program is free of charge and open to the entire community. E Komo Mai and Mele Kalikimaka.

Transit Agency to Hold Briefings on Hele-On Bus Routes

The Hawai`i County Transit Agency will hold public informational meetings to discuss the following:

Kuakini Highway Construction

Construction work to widen Kuakini Highway, from Palani Road to Hualalai Road, commenced on November 8.

Kuakini Highway will be widened to four lanes for automobiles, including two through-lanes in each direction, and a pocket lane for left turns where appropriate. In addition, there will bicycle lanes on both sides throughout most of the project. The construction will last 18-24 months.

One lane will be open at all times from 8:30 a.m. to 3:00 p.m. while construction is in progress. Outside of these hours, one lane in each direction will be open.

The contractor, Hawaiian Dredging, will work with the adjacent businesses and residences to assure that a reasonable access to the businesses and residences will be maintained throughout the construction period. However, motorists traveling in the area should drive with caution.

We are most grateful for the public’s patience and apologize for any inconvenience caused.

The public is invited to a weekly update on the Kuakini Highway, Palani Road to Hualalai project every Tuesday at 7:30 a.m. at the Kona Mayor’s West Hawai`i Office conference room at Hanama Place. Light refreshments will be served.

Representatives from the contractor, Hawaiian Dredging, and the County, Public Works Department are available at the meetings. Everyone is welcome at these informal "talk story" sessions.

Update as of Week of December 5:

Paving has been completed on the upper portion of Ololi Road. Ololi Road remains closed for through traffic; and access is available for local traffic only. Improvements on the lower portion of Ololi Road are pending.

The Kalawa Street extension to Hualalai Road has been paved but will not be opened until incidental work and safety concerns are addressed. When finally opened to traffic, only right-in, right-out traffic movements at Hualalai Road will be allowed.

Hanama Place waterline improvements between Kuakini Highway makai to Kona Trade Center will continue.

Work is being done on the Kuakini shoulders and right-of-way.

The overall project plan includes planting of trees and other landscaping, and relocation of some trees. Unfortunately, trees and foliage affected by the project must be removed in order to conduct the necessary improvements. Adjacent property owners who would like to remove their existing landscaping within the County Right-of-Way fronting their property are advised to coordinate with the County or the contractor.

Landscaping details are available at the West Hawaii Mayor’s office for inspection (call 329-5226 if necessary for directions).

The Tuesday morning updates will continue, and information will also be available via the County website.

Household Hazardous Waste Collection Days Dec 4 and 11

The County of Hawai`i’s household hazardous waste collection will take place again in Hilo and Kailua-Kona. Don’t miss this opportunity to clear your garage of unwanted and dangerous items. The collection, sponsored by the County of Hawai`i’s Department of Environmental Management, is a twice-yearly amnesty program to dispose of household hazardous waste products.

The collections will take place from 7:30 a.m. to 2:30 p.m.:

Dumping household hazardous waste in your trash can cause groundwater contamination.

Household hazardous waste that is collected on these dates is shipped to the mainland for lawful and safe disposal.

Hazardous waste materials being accepted include automotive fluids, all types of batteries, corrosives, mercury thermometers, oil-based paints and stains, solvents and thinners, garden supplies, poisons, and miscellaneous hazardous household chemicals. In addition, clean and/or contaminated used motor oil will be accepted.

Materials that WILL NOT be accepted include waste from a business, explosives, pyrophoric, water-reactive, biological, infectious, radioactive, and shock-sensitive materials, as well as latex paint and base, compressed gas cylinders, flares, fire extinguishers, detergents, non-hazardous items, and non-household generated waste.

3rd Annual Great Tricycle Race in Hilo Dec 11

The East Hawaii Coalition for the Homeless, a non-profit agency in Hilo, will be holding the 3rd Annual Great Tricycle Race & Christmas Hoolau’lea on Saturday, December 11 in downtown Hilo at Mooheau Park from 8:30 a.m.-4:00 p.m.

EHCH invites the community to form teams and compete in the Great Tricycle Race. A team consists of 5 members who will race in a relay, peddling from the starting line to tag the next teammate until the last teammate crosses the finish line.

The defending champions, the "Mayor’s Elves" will compete again this year to defend their title. The Mayor’s Elves consist of members from the Mayor’s Office: Janet Snyder, Andy Levin, Billy Kenoi, Wendell Hatada and Rose Bautista. Deadline to register for the race is Wednesday, December 8th. In addition to the tricycle race, there will also be arts and crafts, food, a silent auction, music and lots of fun. Proceeds will benefit the homeless program in East Hawaii.

20th Annual Kailua-Kona Christmas Parade on Dec 11

Come along to the 20th Annual Kailua-Kona Christmas Parade "Keiki Christmas" on Saturday, December 11 starting at 5:30 p.m.

The parade route will span from Coconut Grove Marketplace, through Kailua Village, to Lanihau Center, via Ali’i Drive, Palani Road and Kopiko Street.

Applications now are being accepted for entries in this holiday event. Schools, churches, businesses, service clubs, other community organizations, military units and individuals are invited to enter the event.

The entries are expected to include at least one band, a color guard, several marching units, floats, keiki groups, decorated cars and Santa Claus.

Prizes will be awarded to entries rated the best in the following four categories: marching units, keikis, floats and commercial.

There is no charge for entries from non-profit groups; the fee per commercial participant is $20 and per political entry is $25. Donations are welcomed to help cover the cost of traffic control, insurance and other expenses. Deadline to submit entries is December 4th.

Ka’u to South Kona Water Master Plan Final Report Available for Viewing

The County of Hawaii and its consultant Townscape, Inc. have completed the Ka’u to South Kona Water Master Plan Final Report.

The Master Plan was initiated to address potential water sources and water distribution systems for the southwest portion of the Big Island. The objective was to develop a long-range plan to provide water for homes, commercial businesses and farmers in the Ka’u to South Kona region.

The plan is now available on the County of Hawaii website at: http://co.hawaii.hi.us/info/k2skwmp/info.htm .

Hard copies of the report will also be available at Pahala, Naalehu, and Kealakekua Public Libraries and at the Ocean View Community Association Center.

Free Mulch Available at Kealakehe, Hilo Transfer Stations

Back by popular demand! High-quality free mulch is now available at the new public pick-up area adjacent to the Kealakehe Transfer Station. The access to the new mulch pick-up area is directly across the street from the transfer station chutes. Residents may self-load mulch at the site from 6:30 a.m. to 6:30 p.m., seven days a week. Bring a pitchfork and help yourself.

Please also note that green waste drop offs have resumed at the Kealakehe Transfer Station. A big Mahalo to all residents for your patience and cooperation.

Plenty of free mulch is also available at the Hilo Transfer Station which is open 7 days a week, 7:00am-5:00pm. The green waste pick-up and drop-off area is just past the entrance to the transfer station chutes on the right-hand side of the road.

The County of Hawai`i’s Department of Environmental Management sponsors the free mulch program. At this time, loading assistance for small vehicles is available only at the Hilo location and fees range from $10-$40 depending on vehicle size.

If you want to arrange for a large truckload to be delivered to your residence, business, or farm, from either the Hilo or Kona green waste processing sites, please call the Big Island Recycling representative at (808) 306-1876 to make those arrangements.

UH Hilo Offers Courses at Parker School in Waimea from Jan 10

The University of Hawaii at Hilo, through the North Hawaii Education and Research Center, is offering two courses, starting January 10, 2005, at the Parker School in Waimea. The courses are:

Both courses are open to adults pursuing university credit and degrees. The courses are also available to qualified high school juniors and seniors as Running Start classes, offering dual high school and college credit. Scholarships are available to high school students in Gear Up schools.

High School students should apply as "EARLY ADMIT" students. The UH Hilo application and Running Start forms are available with high school counselors. Adults should apply to UH Hilo as "unclassified" students.

UHH Senior College Courses for Spring Semester from Jan 10

UH-Hilo’s Senior College offers lifelong learning outreach classes to adults over the age of 45 years, in communities throughout the Big Island.

Spring semester classes start Jan. 10, 2005 and run through May 2005. Schedules vary by location. Classes are generally for 4 weeks, 1.5 hours a week, and generally cost $25. (Note: Some courses are free with the teachers donating their time; while other courses are sponsored by community agencies.)

Among the courses will be Hawaiian ethnobotany in Kona, docent training at the Pana’ewa Rainforest Zoo and golf basics in Volcano.

Kona Outdoor Circle Master Gardener Scholarship

Kona Outdoor Circle is offering a full scholarship for the Master Gardener Certification Program. The course is offered by Kona Outdoor Circle in cooperation with the University of Hawai’i.

The Julie M. Ellison Fund scholarship is for $225, which enables the recipient to complete the three series of classes offered annually. Participation in the three series of classes and passing the tests at the end of each series is required, along with volunteer hours, to complete the requirements for certification as a Master Gardener.

The scholarship fund was established in honor of Julie Ellison, who was born in the Islands. Her passion was landscape design, which she taught herself from the ground up by working at nurseries and on grounds crews.

She owned and operated her own landscape design business, The Art of Gardens, and was a two-time winner of Kona Outdoor Circle’s Beautification Awards. Sunset Magazine also featured her design work.

Following her death in 2002, the Julie M. Ellison Fund was established to provide scholarships for individuals participating in the Master Gardener Certification Program.

To be eligible for the scholarship, the applicant must be accepted into the Master Gardener Certification Program and state his or her intention to complete the certification process. Students who have already completed one or two series of classes are eligible, as well as new students in the program.

Christmas Gift Wishing Tree for Homeless Children Nov 20-Dec 20

Community Alliance Partners, a team comprised of agencies and organizations that serve the homeless population, has been organizing outreach activities to enhance public awareness of homeless issues in Hawai`i County.

Among the outreach activities is a Wishing Tree decorated with Christmas gift wishes of homeless children, on display at the Hilo Shopping Center from November 20 to December 20.

The Wishing Tree is decorated and administered by the Christmas Wish program – a not-for-profit group that provides Christmas gifts to homeless children during the holidays.

Those who wish to donate may sponsor a child by purchasing a gift from the tree, which will be given to that sponsored child on Christmas Eve. One may also bring a toy to donate, which will be gifted at an annual Christmas party held for the homeless community. Kealakehe Connector Road Opening for School Bus Travel from Dec 6

The public is advised that the Kealakehe Connector Road, between Kealakehe Street and Keanalehu Drive, will be opened for school bus travel beginning on Monday, December 6, 2004.

Once opened, school buses will be allowed to use this connector road on school days, during the following times.

The purpose of this opening is to (1) help reduce the vehicular traffic on the Queen Kaahumanu Highway and Palani Road, (2) substantially reduce the travel times for the school buses, and (3) encourage student ridership of the buses.

Our police officers and the Kealakehe Neighborhood Watch group will be stationed in the area to monitor this activity. We ask all motorists to use caution when driving around this area, and be mindful of the changes that have taken place.
